Please read this Notice carefully to understand what the Company does.   2. Information Collected. In connection with your use of the Site and/or your participation in the Virtual Event, the Company will collect the following information made accessible through your Strava account: (a) your first name, last name, and email address (collectively, “Sharable Data”); and (b) additional data accessible through and collected from your Strava user account, including but not limited to location data (longitude and latitude), gender, age and activity data (collectively, “Strava Data”).
  3. Use and Sharing of Information. You hereby consent to the use and sharing of your information as described below:
    1. To Provide Access To Content and Services. The Company will use and process your Sharable Data and your Strava Data in order to provide services in connection with the Virtual Event, such as compiling, processing and generating competitive race results. When Strava Data is collected with respect to a Virtual Event, the Company will cache and process your Strava Data for use with respect to such Virtual Event only.
    2. Advertising.  The Company may use your Sharable Data to provide you with advertisements and other marketing communications for the Company or its advertising partners.
    3. Sharing.  From time to time the Company may share your Sharable Data with third parties for advertising or other purposes. As described above, the Company will cache and process your Strava Data only for purposes in connect with the Virtual Event for which such Strava Data was collected. The Company will not share your Strava Data with third parties. Notwithstanding any of the foregoing, the Company will share your Sharable Data and your Strava Data with third party companies, organizations or individuals outside of the Company if the Company has a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to: (i) meet any applicable law, regulation, subpoena, legal process or enforceable governmental request; (ii) detect, prevent, or otherwise address fraud, security or technical issues; or (iii) protect against harm to the rights, property or safety of the Company, you, the Company’s other users (including other Virtual Event participants), or the public as required or permitted by law.
    4. Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of the Company’s business changes or the Company otherwise transfers assets relating to the Company’s business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, the Company may transfer or sell your personal information to the new owner.
  4. Limitation of Liability. THE COMPANY AND ANY THIRD PARTIES MENTIONED ON THE SITE ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM PERSONAL INJURY, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING IN ANY WAY TO A VIRTUAL EVENT, THE SITE, SERVICES PROVIDED BY THE COMPANY IN CONNECTION WITH A VIRTUAL EVENT AND/OR THE SITE, CONTENT OR INFORMATION CONTAINED WITHIN THE SITE, AND/OR ANY LINKED WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH A VIRTUAL EVENT, THE SITE, SERVICES PROVIDED BY THE COMPANY IN CONNECTION WITH A VIRTUAL EVENT AND/OR THE SITE, AND/OR LINKED WEBSITES IS TO CEASE PARTICIPATION IN THE VIRTUAL EVENT, STOP USING THE SITE AND/OR STOP USING ANY COMPANY-PROVIDED SERVICES, AS APPLICABLE. TO THE EXTENT ANY ASPECTS OF THE FOREGOING LIMITATIONS OF LIABILITY ARE NOT ENFORCEABLE, THE MAXIMUM LIABILITY OF COMPANY TO YOU WITH RESPECT TO YOUR PARTICIPATION IN A VIRTUAL EVENT OR YOUR USE OF THE SITE IS $100 (ONE HUNDRED DOLLARS).
  5. Medical Advice Disclaimer. The content of the Site and/or content otherwise made available in connection with a Virtual Event, including without limitation, text, copy, audio, video, photographs, illustrations, graphics and other visuals, is for informational purposes only and does not constitute professional medical advice, diagnosis, treatment or recommendations of any kind. You should always seek the advice of your qualified heath care professionals with any questions or concerns you may have regarding your individual needs and any medical conditions. Company does not recommend or endorse any specific activities, tests, physicians, products, procedures, opinions or other information that may be included on or accessible through the Site. Participation in any Virtual Event, and reliance on any information appearing on or accessible through the Site, whether provided by Company, its content providers, its clients, visitors to the Site or others, is solely at your own risk.
  6. Dispute Resolution. In the event of any dispute or claim relating to a Virtual Event, the Site or this Notice, you agree to resolution of such dispute in the state or federal courts located in Montgomery County, Pennsylvania, in accordance with Pennsylvania law.

Claims” includes but is not limited to any and all liabilities, claims, demands, legal actions, rights of actions for damages, costs, procedures, personal injury or death in connection with participation in the Activity.  “Released Party” means lululemon athletica canada inc., lululemon usa inc., and all of their affiliates, franchisees and their respective representatives, directors, officers, agents, employees and volunteer staff.
  3. I agree and acknowledge that: (a) I am in proper physical condition to participate in the Activity, and am aware that participation could, in some circumstances, result in physical injury, serious physical injury or death; (b) I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured; (c) if, in the subjective opinion of any Released Party, I would be at risk by participating in the Activity, I may be denied access to the Activity and related facilities until I furnish an opinion letter from my medical physician, at my sole cost and expense, specifically addressing the Released Party’s concerns and stating that the Released Party’s concerns are unfounded; (d) at all times I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to me by any Released Party; and (e) I am aware that if the Activity occurs outdoors, the streets adjourning the area of the Activity are open to regular vehicular traffic during the Activity and I will obey all traffic laws and regulations.
  4. I hereby, for myself and for my heirs, next of kin, executors, administrators and assigns, fully release, waive and forever discharge any and all rights or Claims I may have, now or in the future, against any Released Party, even if the Claims are based on the carelessness or negligence of a Released Party or anyone else.  Without limiting the foregoing, I further release any recourses which I may now or hereafter have resulting from any decision of any Released Party.
  5. I agree not to sue any Released Party for Claims, even if the Claims arise from the carelessness or negligence of any Released Party or anyone else.  I agree to indemnify (reimburse for any loss) and hold harmless each Released Party from any loss or liability (including any reasonable legal fees they may incur) defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the carelessness or negligence of any Released Party or anyone else.
  6. I am aware that it is advisable to consult a physician prior to participating in the Activity. I: (a) have no physical or medical condition which would prevent me from properly and safely participating in the Activity; (b) have not been instructed by a physician to avoid physical activity and/or exercise; and (c) if I have consulted a physician, I have taken my physician’s advice.
  7. I am aware that there is no obligation for any person to provide me with medical care during the Activity.  I understand and acknowledge that: (a) there may be no aid stations available for the Activity; and (b) If medical care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered.
  8. I grant my permission to the Released Party and any transferee or licensee or any of them, to utilize any photographs, motion pictures, videotapes, recordings and other references or records of the Activity which may depict, record or refer to me for any purpose (“Images”), including commercial use by the released parties, their sponsors and their licensees.  This permission is for use anywhere in the world and on the Internet and for an unlimited period of time.  I understand and agree that I will not be compensated or receive additional consideration for consenting to the use of the Images and that I will not be given a chance to receive, inspect or approve the promotional or marketing material, messages and/or content that may use the Images.  I hereby release the Released Party including, without limitation, all persons who took or otherwise created, recorded or modified the Images, from any and all claims, actions, damages, interest, costs, expense and compensation of whatsoever kind and howsoever arising, whether known or unknown, and which I now have or at any time hereafter can, shall or may have in connection with, or in any way resulting or arising from, the Images and the creation, use or disposition of them.
  9. I acknowledge and agree that the Released Party shall own all right, title and interest, throughout the world, in and to the Images and any materials compromising all or any part of the Images, and that the Released Party has the unrestricted right to use, license, sell, transfer or otherwise dispose of any or all of them, as well as the Released Party’s rights under this Release and Waiver, in any manner whatsoever and without any accountability to me. I hereby assign to the Released Party all right, title and interest, throughout the world, I may have in and to the Images and any materials comprising all or any part of the Images, including all intellectual property rights thereto. I hereby irrevocably waive any and all of my moral rights and any other irrevocable rights I may have, throughout the world, in or to the Images and any materials comprising all or part of the Images.
  10. I understand that some of the information provided by me, including, but not limited to, my name, address, and date of birth (the “Information”) will be collected and used by the Released Party, and I consent to the transmission of the Information to the Released Party, its agents and/or service providers and authorize the Released Party, its agents and/or service providers to record, process and store such Information as necessary for purposes of providing and administering the Activity and in accordance with the Released Party’s Privacy Policy, located at  http://www.lululemon.com/privacy?mnid=ftr;privacy
  11. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
  12. I have fully read and understand this agreement.  I am aware that by signing this agreement, I am waiving certain legal rights I or my heirs, next of kin, executors, administrators and assigns may have against the Released Party.
  13. If this Event is taking place in Canada, this Event Release and waiver will be construed in accordance with the laws of the Province of British Columbia.  If this Event is taking place in the United States of America, this Event Release and waiver will be construed in accordance with the laws of the State of New York.  Each party irrevocably submits to the exclusive jurisdiction of the state and federal courts located in New York with respect to resolution of disputes arising under this Agreement.
  14. IF PARTICIPANT IS UNDER 18, a parent or legal guardian of the Participant named above must sign a waiver on behalf of the Participant before the Participant can participate in the Activity.

  7. Je sais que personne n’est tenue de me fournir des soins médicaux pendant l’activité. Je comprends et reconnait : a) qu’il se peut qu’il n’y ait aucun poste de premiers soins de disponible pendant l’activité; et b) que si des soins médicaux me sont prodigués, que je consens à ces soins si je suis incapable de donner mon consentement pour quelque raison au moment où les soins me sont prodigués.
  8. Je permets à la partie libérée et aux cessionnaires ou franchisés ou à l’un d’eux, d’utiliser les photographies, films, bandes vidéo et enregistrements de l’activité et les autres images de l’activité sur lesquels j’apparais ou qui me représentent pour quelque fin (les « images»), y compris à des fins d’utilisation commerciale par les parties libérées, leurs commanditaires et leurs franchisés. Cette permission peut être utilisée où que ce soit dans le monde et sur Internet et vaut pendant une période illimitée. Je comprends et conviens que je ne recevrai pas de rémunération ni de contrepartie supplémentaire pour avoir consenti à l’utilisation des images et que je n’aurai pas l’occasion de recevoir, d’inspecter ou d’approuver les documents de promotion ou de commercialisation, les messages et/ou le contenu pouvant utiliser les images.   11. Si toute disposition de la présente convention est illégale, nulle ou inopposable pour quelque raison, cette disposition est réputée ne pas faire partie de la présente convention et n’a aucune incidence sur la validité et l’opposabilité des dispositions restantes.
  12. Si le participant est âgé de 18 ans ou moins, son parent ou tuteur convient des énoncés suivants : à titre de parent ou de tuteur du participant mineur, j’autorise le participant mineur à participer. Je conviens que si le participant mineur ou quiconque agissant pour son compte devait faire une réclamation, je fournirai l’indemnisation décrite au paragraphe 5, et je conviens des modalités de la présente libération et renonciation. S’il survient une urgence médicale visant le participant mineur et que la partie libérée est incapable de communiquer avec moi, je conviens et consens à ce que la partie libérée prodigue des soins médicaux au participant mineur.
  13. J’ai lu intégralement la présente convention et je la comprends. Je sais qu’en signant la présente convention, je renonce à certains droits juridiques que mes héritiers, plus proches parents, liquidateurs, administrateurs et ayants droit et moi-même pouvons avoir contre la partie libérée.
  14. La présente libération et renonciation — Événement en magasin sera interprétée conformément aux lois de la province de la Colombie-Britannique. Chaque partie reconnaît irrévocablement la compétence exclusive des tribunaux provinciaux et fédéraux situés à Vancouver, en Colombie-Britannique, à l’égard du règlement de différends découlant de la présente convention.
